Mediation allows parties to resolve differences and disputes through discussion and problem solving. It is essentially a structured negotiation conducted by a third party who has no interest in the outcome.

 

Arbitration uses an impartial third party to render a decision based on the facts presented by the parties.

 

Both allow you to avoid the expense, both in time and money, as well as the publicity involved with litigation.

 

Discourage litigation. Persuade your neighbors to compromise whenever you can. Point out to them how the nominal winner is often a real loser — in fees, expenses, and waste of time. As a peacemaker the lawyer has a superior opportunity of being a good man. There will still be business enough.
